By downloading, installing, or using any ProgInsight software, application, or service — including desktop apps, mobile apps, and web apps — you agree to be bound by these Terms of Service. Please read them carefully before using our products.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of all software, applications, websites, and services provided by ProgInsight ("we", "us", or "our"). Our products are organised into the following categories:
- Intelligent Suite — AI-powered productivity applications prefixed with "Intelligent" (e.g. planners, writers, research tools, and related utilities).
- 4all Ecosystem — Cross-platform sharing, storage, and collaboration tools prefixed with "4all".
- Standalone Applications — Independent tools developed outside the suite alignment model, each serving a focused, self-contained purpose.
- Web Apps — Browser-based applications and services accessible via proginsight.com and affiliated web properties.
These Terms apply to all products across every category, as well as any future products we release. If you do not agree to these Terms, please do not use our products or services.
2. Use of Our Software
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable licence to install and use our applications on devices you own or control, for personal or professional purposes.
You may not:
- Reverse-engineer, decompile, or disassemble our software, except where expressly permitted by applicable law.
- Redistribute, resell, or sublicense our software without prior written permission from ProgInsight.
- Use our software to violate any applicable law or regulation, or to facilitate illegal activity.
- Attempt to gain unauthorised access to our systems, backend services, APIs, or other users' data.
- Remove, obscure, or alter any proprietary notices, labels, or branding within our software.
- Use our software to scrape, harvest, or collect data from third-party services in ways that violate those services' own terms.
- Abuse or circumvent any rate limits, cooldown periods, or usage controls built into our services (including the feedback and complaint submission system).
3. Telemetry and Usage Data
Our applications include an optional telemetry system that collects anonymous usage statistics (feature usage events, error signals, app version, and OS information) to help us improve our products. This is enabled by default but you can opt out at any time in the application settings.
We do not collect personally identifiable information through telemetry. Usage events are keyed to an irreversible hardware hash — not your name, email address, or any account credential. Full details of what we collect and how we protect your identity are set out in our Privacy Policy.
By using our software with telemetry enabled, you consent to the collection of anonymous usage data as described above and in the Privacy Policy.
4. In-App Advertising
Some ProgInsight applications and our website (proginsight.com) display advertisements served by third-party advertising networks, including Google AdSense, Unity Ads, and others. These ads help us fund the continued development and free distribution of our software.
We do not share your personal data or telemetry data with advertising networks. Ad networks receive only what your device transmits automatically when loading an ad (such as your IP address and device type). You can manage ad personalisation preferences as described in our Privacy Policy, Section 8.
5. Optional Account Features and Sign-In Providers
Some ProgInsight services offer optional account-based features, such as syncing preferences across devices. These features use third-party identity providers for authentication via OAuth 2.0. We currently support sign-in through Google, GitHub, and Microsoft, and we may expand the list of supported providers over time. Creating an account is not required to use the core functionality of any ProgInsight product.
When you sign in through any supported provider, we receive only the minimum profile information needed to identify your account — typically your name and email address. We do not access your data held by the identity provider beyond this (such as files, emails, calendars, or contacts). See our Privacy Policy, Section 2c for full details.
6. Optional Cloud Storage Integration
Some ProgInsight applications offer optional integration with third-party cloud storage providers (including Google Drive, Microsoft OneDrive, Dropbox, Apple iCloud, and others) to let you save or sync data to your own cloud account.
These integrations are strictly opt-in. When you connect a cloud account, we access only the files and folders our application needs to perform the function you requested. We never store the contents of your cloud files on our own servers. You can revoke cloud access at any time from within the app or from the provider's own account settings. Full details are in our Privacy Policy, Section 9.
7. User-Controlled Cloud Bucket Storage
Some ProgInsight applications support a bring-your-own-bucket (BYOB) feature that lets you back up or store your data directly to a cloud object storage bucket you own — such as Amazon S3, Cloudflare R2, Backblaze B2, or any S3-compatible provider.
- You supply your own bucket credentials (access key, secret key, bucket name, and endpoint URL). These are stored encrypted on your device and used only to communicate with your bucket. ProgInsight never receives or stores your bucket credentials.
- You are solely responsible for your bucket's security configuration, access permissions, and any costs your provider charges for storage and data transfer.
- ProgInsight is not liable for data loss, unauthorised access, or costs arising from misconfiguration of your bucket or from your provider's own service issues.
- You must not use the bucket backup feature to store content that violates applicable law or your bucket provider's terms of service.
8. Bring Your Own Key (BYOK) — AI Services
Several ProgInsight applications include AI-powered features. We offer two modes of operation:
ProgInsight-Operated AI
AI requests are processed through ProgInsight's own backend infrastructure, which may in turn use third-party AI providers (such as Cloudflare AI, Amazon Bedrock, or others) under data processing agreements. You are billed by ProgInsight for usage under your plan. We do not use the content of your AI prompts or responses to train models.
Bring Your Own Key (BYOK)
You may supply your own API key from a third-party AI provider (such as OpenAI, Anthropic, Google Gemini, Cloudflare AI, or Amazon Bedrock) so that AI requests are authenticated under your own account:
- Your API key is stored encrypted on your device and is never transmitted to ProgInsight servers.
- You are billed directly by the AI provider at your own account's rates. ProgInsight does not bill you for AI usage in BYOK mode.
- You are responsible for keeping your API key secure. Do not share it. ProgInsight is not liable for charges or data exposure resulting from a compromised key.
- Your use of a third-party AI provider under BYOK is governed by that provider's own terms of service and privacy policy. ProgInsight makes no warranty regarding the availability, accuracy, or safety of any third-party AI model.
- You must not use BYOK mode to send prompts that violate the acceptable use policies of the AI provider whose key you are using.
9. Payments, Subscriptions, and Licensing
While many ProgInsight products are free, some are paid. The following terms apply to all purchases made through ProgInsight.
Purchase Models
- Subscription: Recurring billing (monthly or annual) for access to a product or feature set. Your subscription renews automatically until you cancel. Cancellation takes effect at the end of the current billing period — you will not be charged again after cancellation, and access continues until the period expires.
- One-time purchase: A single payment grants a perpetual licence to use the specified version of the product (or as otherwise stated at point of sale). Updates beyond the specified version may require a new purchase or upgrade fee.
- Voucher / redemption code: A code that grants access to a product or applies a credit to your account. Vouchers are single-use unless stated otherwise. Vouchers have no cash value and cannot be transferred or refunded once redeemed.
Pricing Bonuses and Discounts
ProgInsight may offer price reductions or bonuses through the following mechanisms:
- Referral and agent bonuses: Accessing our store or application through a qualifying referral link or affiliated agent may apply a discount at checkout. The agent identifier is recorded against your purchase for commission and audit purposes and may be shared with the qualifying partner for settlement.
- Promotional sales: Time-limited discounts applied automatically during sale periods.
- Claimed discounts: Reductions you claim by providing qualifying information (for example, an educational or organisational affiliation). By claiming a discount you confirm the qualifying information you provide is accurate. Providing false information to obtain a discount constitutes misuse and may result in licence revocation without refund.
- Loyalty and tier discounts: Reductions based on your subscription tier or purchase history.
Discounts cannot be combined unless explicitly stated. ProgInsight reserves the right to withdraw or modify any discount offer at any time prior to purchase completion.
Payments and Billing
Payment processing is handled by third-party payment processors. ProgInsight does not store your card number, CVV, or bank account details. You authorise your payment method to be charged at the price displayed at the time of purchase, and for subscriptions, at each renewal date. All prices are inclusive of applicable taxes where stated, or exclusive of taxes where you are responsible for VAT, GST, or equivalent.
Refunds
Refund eligibility depends on the product and jurisdiction. As a general policy: subscription payments are non-refundable for the current billing period once access has been granted, but you may cancel to prevent future charges. One-time purchases may be refunded within 7 days of purchase if the product has a critical defect we cannot resolve. Vouchers and redeemed codes are non-refundable. Contact team@proginsight.com for refund requests.
Licence Suspension and Revocation
We reserve the right to suspend or revoke your licence without refund if you: breach these Terms; attempt to circumvent licence enforcement; share licence keys with unauthorised users; or provide false information to obtain a discount or product access.
10. SDK and Library Licensing
ProgInsight develops software libraries and SDKs — including telemetry libraries, AI integration components, and other internal tools — that may be licensed to third-party developers and organisations for use in their own products.
- Licence scope: SDK licences are granted under separate written agreements that define permitted use, distribution rights, and royalty terms. No SDK licence is implied by these Terms alone.
- Restrictions: SDK licensees may not sublicense, resell, or redistribute ProgInsight SDK components to further third parties without explicit written permission. Licensees may not remove ProgInsight attribution or misrepresent the origin of SDK components.
- End-user data: Third-party developers who integrate ProgInsight SDKs are solely responsible for their own users' data and for providing appropriate privacy disclosures. ProgInsight does not receive personal data from end users of third-party applications unless explicitly configured and disclosed.
- No warranty: SDKs and libraries are provided under the terms of the applicable licence agreement. ProgInsight makes no warranty that SDK components will be error-free or fit for any particular purpose beyond what is stated in that agreement.
11. Third-Party Libraries and Components
ProgInsight products may incorporate third-party software libraries, frameworks, and components to support certain features and functionality. Where we do so:
- Compliance with third-party terms: We commit to complying with the terms of service, licence agreements, and acceptable use policies of any third-party library or component we integrate into our products. We review these terms as part of our development process and will cease or modify any use that falls out of compliance.
- Customer protection: We take care to evaluate third-party components for privacy and security implications before integrating them. We do not integrate third-party libraries in ways that would expose your personal data, usage patterns, or device information to those third parties beyond what is necessary and disclosed in our Privacy Policy.
- Open-source components: Some third-party libraries included in our software are distributed under open-source licences (such as MIT, Apache 2.0, or similar). These components are governed by their respective licences, which are documented within each application or through its official source repository. Your use of our software does not alter your rights or obligations under those open-source licences.
- No endorsement: The inclusion of a third-party library in our products does not constitute an endorsement of that library's developer or their other products and services.
- Changes over time: The third-party components we use may change between product versions. We will reflect any material changes that affect your data or rights in an updated Privacy Policy or these Terms.
12. Intellectual Property
All ProgInsight software, source code, logos, graphics, and website content are the exclusive property of ProgInsight and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
Open-source components bundled within our software are governed by their respective licences, which are documented within each application or through its official source repository.
13. Distribution and Downloads
ProgInsight software is distributed through a range of official channels, including app stores, software marketplaces, and other authorised distribution platforms. We do not authorise redistribution through any channel not officially designated by ProgInsight. If you obtained our software from an unofficial source, we cannot guarantee its integrity or safety.
We track software downloads and file processing events in aggregate (not linked to your personal identity) to understand adoption and improve distribution. Individual download records are stored locally on your device only.
14. User-Submitted Feedback and Complaints
Our applications include an in-app feedback and complaint submission feature. When you submit feedback:
- Your message, along with automatic context (app version, OS, and last few usage events), is sent to our servers to help us diagnose the issue.
- Your email address is never collected automatically. You may optionally provide it if you wish us to follow up with you.
- A cooldown period applies between feedback submissions to prevent abuse.
- We may use submitted feedback to improve our software, fix bugs, and prioritise features.
By submitting feedback, you agree that ProgInsight may use the content of your submission (excluding any personal contact details you provide) for product improvement purposes.
15. Updates and Availability
We may release updates, patches, or new versions of our software at any time. Some updates may be required for continued use of certain features. We reserve the right to modify, suspend, or discontinue any product or service — in whole or in part — at any time. Where possible we will provide advance notice of significant changes.
16. Disclaimer of Warranties
Our software — whether free or paid — is provided "as is" and "as available", without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our software will be error-free, uninterrupted, or secure, or that it will meet your specific requirements. Payment for a product grants you a licence to use it; it does not constitute a warranty of performance beyond what is described in the product's documentation at the time of purchase.
AI-generated outputs produced by ProgInsight applications — whether through our own infrastructure or via BYOK — are provided for informational and productivity purposes only. We make no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated content. You are responsible for reviewing and verifying any AI output before relying on it.
Some ProgInsight tools — particularly certain Standalone Applications and web apps — interact with third-party services and content. You are solely responsible for ensuring your use of such tools complies with the terms of service of those third-party platforms and with applicable copyright and intellectual property law in your jurisdiction.
17. Limitation of Liability
To the fullest extent permitted by applicable law, ProgInsight and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or business interruption — arising from your use of or inability to use our software or services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of our software shall not exceed the total amount you paid to ProgInsight in the twelve months preceding the claim.
18. Privacy
Your use of our software and website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains in detail what data our telemetry system collects, how advertising works across our products, how cloud integrations handle your files, and your rights regarding your data. Please review it.
19. Third-Party Services
Our software and website integrate with or link to third-party services, including but not limited to authentication providers, cloud storage services, advertising networks, payment processors, and distribution platforms. These services are governed by their own terms and privacy policies. We are not responsible for the content, availability, policies, or practices of any third-party service.
20. Changes to These Terms
We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes we will provide notice where reasonably practicable. Your continued use of our software or services after changes are published constitutes acceptance of the revised Terms.
21. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved in good faith through direct communication with our team before pursuing any formal legal proceedings.
